"Notwithstanding any other provisions of this chapter, a public utility district may provide telecommunications services to end users as a provider of last resort. For the purposes of this chapter, such services may be provided under the following circumstances: A district that has constructed telecommunications facilities may provide telecommunications services to end users over those facilities and market such services if retail service providers have been given the opportunity to use such facilities but either fail to deliver that service at all or after one year fail to attract as customers of their service more than 50 percent of the total number of end users that have access to such facilities. The district shall cease to provide telecommunications services and transfer the end users to a retail service provider at such time that retail service providers deliver that telecommunications service to more than 50 percent of the total number of end users, including those previously served by the district, that have access to such facilities constructed by the district."
